Terms and Conditions

Promoter

Mondelez Australia Pty Ltd (ABN 78 004 551 473), Level 10, 75 Dorcas Street, South Melbourne VIC 3205.

Competition Period

12.01am (AEST) on 01/06/2021 to 11.59pm (AEST) on 24/08/2021, or when 60,000 prizes are claimed, whichever occurs first.

Who can claim?

Only Australian residents who are aged 18 or over.

Who can't claim?

Directors, officers, management and employees (and their immediate families) of:

  1. the Promoter; and
  2. the agencies, companies or participating premises associated with this competition.

Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

Where will the competition run?

The competition will run in participating Woolworths stores (including online) which stock specially marked products (Stores).

Qualifying Purchase

Any 180g Cadbury Dairy Milk milk chocolate block specially marked with communication about this Promotion from a Store during the Competition Period.

Claim instructions

To claim, you must, during the Competition Period:

  1. make a Qualifying Purchase from a Store and collect your itemised purchase receipt; and
  2. visit the Website, locate the claim page and fill out and submit the online claim form, including uploading an image of the Qualifying Purchase receipt, providing three words that appear on the block mould of your specially marked block and all other requested information. Words you may find on your specially marked block include, but are not limited to, Cadbury, Love, Creamy, Choc, Friends, Yum, Family, Share.

For the avoidance of doubt, the words must appear on the block in its entirety. The block cannot be broken up to create words.

Your purchase receipt must clearly identify where the Qualifying Purchase was made, the product purchased (which must be a Qualifying Purchase) and the date of purchase (which must be during the Competition Period before you submitted your claim).

The Promoter is not responsible if your mobile device/desktop is not sufficiently capable for the purpose of submitting a claim, including having the requisite photograph capability.

What can I win?

There are 60,000 prizes available during the Competition Period.

The first 60,000 valid claims received by the Promoter during the Competition Period will receive a prize.

Each prize is a 180g block of Cadbury Dairy Milk milk chocolate, awarded in the form of a $5 WISH eGift Card.

For the avoidance of doubt, the eGift Card is not required to be used to purchase a 180g block of Cadbury Dairy Milk milk chocolate and can be used online or in-store.

Total prize pool

The total prize pool is up to $300,000.

How many times can I claim?

There is a limit of four (4) claims per household as determined by residential address, subject to a limit of one (1) claim per Qualifying Purchase. Each claim must be submitted separately in accordance with these Terms and Conditions.

How and when will the winner/s be informed?

Provisional winners will be notified on screen at the time of claiming and will receive their prize by email to the email address provided on the claim form within five (5) business days of claiming.

Should a claim be deemed invalid by the Promoter, the claimant will receive an email within three business days of submitting the claim outlining the reason why the claim was deemed invalid, requesting the claimant to reply to the email within the time specified by the Promoter with any further information to verify the claim.

It is the claimant's responsibility to ensure they provide their correct email address on the claim form. The Promoter will not re-issue a prize if a claimant does not receive the prize due to an incorrect email address being provided.

Proof of purchase

You must keep the following as proof of purchase for all entries:

  • original itemised purchase receipt(s).

If you don't produce the above proof of purchase for all entries when asked the Promoter may disqualify all of your entries and you will lose any right to a prize.

Proof of purchase must be identical to that provided by you with your claim.

If, in the Promoter's opinion, you have shared any proof of purchase with another person, your entries and the entries of that other person will be invalid and you will lose any right to a prize.

Verification Requirements

Claimants may be required to provide proof of identity, proof of age and proof of residency to verify their entry (Proof of Identity). Identification considered suitable for verification is at the Promoter's discretion. If a claimant fails to provide Proof of Identity by the time and date stipulated by the Promoter, their claim will be deemed invalid at the Promoter's discretion.

Undeliverable prize/s

If an awarded prize is returned as undeliverable, and the Promoter can't contact that winner or if a winner does not claim their prize by 5pm (AEST) on 21/09/2021, that prize will be forfeited.

If a prize winner cannot be found, that information will be published on the Website on 22/09/2021.


Collection and use of your personal information

The Promoter may collect your personal information directly or through its agents or contractors. The Promoter will use your personal information to conduct and manage the competition. The Promoter may disclose your personal information to its related companies, agents and contractors to assist in conducting this competition, communicating with you or storing data. This may include disclosures to organisations outside Australia including in places such as New Zealand, Switzerland, Singapore, United Kingdom and the United States of America.

In addition to any use that may be outlined in the Promoter's Privacy Policy (see https://au.mondelezinternational.com/privacy-policy), if a claimant elects to opt in to receive marketing materials from the Promoter by ticking the relevant box on the online claim form, the Promoter may, for an indefinite period, unless otherwise advised, use the personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. The claimant will be able to opt out at any time. The Promoter's Privacy Policy includes information about:

  1. how to seek access to the personal information the Promoter holds about you and seek correction of the information; and
  2. how to complain about a privacy breach and how the Promoter will deal with such a complaint.

  1. These Terms and Conditions incorporate and must be read together with the details outlined in the table above. Information about prizes and how to claim forms part of these Terms and Conditions. By claiming, you accept these Terms and Conditions.

Claim

  1. Your claim must be received during the Competition Period and will be deemed to be received only when received by the Promoter. If you return a Qualifying Purchase your claim may be deemed invalid at the Promoter's discretion (unless the product is defective). The Promoter is not liable for any problems with communications networks. You are responsible for your own costs associated with claiming. If you claim using automatically generated claims or multiple phone numbers/email addresses/addresses/aliases, you may be disqualified.

Prize

  1. Prizes and all elements of prizes must be taken as and when offered or will be forfeited, and if forfeited, the Promoter will not be liable. Prizes are subject to any additional terms and conditions imposed by the relevant supplier or the Promoter, including, validity period/s.
  2. Woolworths Group Ltd ABN 88 000 014 675 is the issuer of the WISH eGift Card, but is not the promoter of the offer, nor responsible for fulfilment of the offer terms. WISH eGift Cards have no expiry date and are redeemable at participating stores only. For a list of participating stores and full Gift Card Terms and Conditions visit woolworths.com.au/giftcards.

General

  1. Any failure by you to comply with the conditions imposed by the prize supplier(s) may result in the prize being cancelled or withdrawn without liability for the Promoter or the prize supplier(s).
  2. If you or your claim are deemed by the Promoter to breach these Terms and Conditions, your claim (or at the Promoter's discretion, all of your claims) may be discarded. The Promoter may, at any time, require you to produce documentation to establish to the Promoter's satisfaction the validity of your claims (including documentation establishing your identity, age, place of residence and place of employment). Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.
  3. You must not:
    1. tamper with the claim process;
    2. engage in any conduct that may jeopardise the fair and proper conduct of the competition;
    3. act in a disruptive, annoying, threatening, abusive or harassing manner;
    4. do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this competition;
    5. breach any law; or
    6. behave in a way that is otherwise inappropriate.
  4. The Promoter is not liable for claims, prize claims or correspondence that are misplaced, misdirected, delayed, lost, damaged, incomplete, illegible or incorrectly submitted.
  5. If any dispute arises between you and the Promoter concerning the conduct of this promotion or claiming a prize, the Promoter will take reasonable steps to consider your point of view, taking into account any facts or evidence you put forward, and to respond to it fairly within a reasonable time. In all other respects, the Promoter's decision in connection with all aspects of this competition is final.
  6. Prizes cannot be transferred or exchanged nor redeemed for cash. Without limiting any other term of these Terms and Conditions, all prizes (and elements of prizes) must be taken as and when specified, or will be forfeited with no replacement. The prize values are correct as at the date of preparing these Terms and Conditions and include any applicable GST. The Promoter is not responsible for any change in prize value. You agree that if a prize (or element of a prize) is unavailable for any reason the Promoter may provide another item of equal or higher value, subject to any necessary approval by the state/territory gaming authorities.
  7. Printing and other quality control errors outside the Promoter's control will not invalidate an otherwise valid prize claim. Every instant win prize claim in excess of the advertised prize pool will be honoured, unless the claim is rejected due to fraud or ineligibility under these Terms and Conditions.
  8. If this competition cannot run as planned for any reason beyond the Promoter's control, for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, the Promoter may end, change, suspend or cancel the competition or disqualify affected claims/claimants. Where it is practical for it to do so, the Promoter will notify you of such changes.
  9. In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify a prize, subject to direction by the relevant trade promotion authorities.
  10. The Promoter is not responsible for any tax implications arising from you winning a prize. You should seek independent financial advice. If for GST purposes this competition results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office's stated view that where the parties are at arm's length, goods and services exchanged are of equal GST inclusive market values.

Liability

  1. Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth).
  2. Subject to the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury(including allergies, skin conditions or other reactions, as relevant), illness or death suffered in connection with this competition or any prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).
  3. Without limiting the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable for any loss of, damage to or delay in delivery of prize/s, or for any damage that occurs to displayed prize/s (where relevant). Unless otherwise specified, prize/s will only be delivered to addresses in Australia.
  4. This competition is in no way sponsored, endorsed or administered by, or associated with any social media platform, including Facebook, Instagram and Twitter. You provide your information to the Promoter and not to any social media platform. You completely release any relevant social media platforms from any and all liability.
